Local Municipal Election court case dropped

The Corporation of the City of North Bay has received notification that an application seeking a court ruling on the validity of the October 22, 2018 municipal election results has been withdrawn.

The Corporation of the City of North Bay has received notification that an application seeking a court ruling on the validity of the October 22, 2018 municipal election results has been withdrawn.

In court documents obtained by BayToday back in late January, North Bay resident Mark Shannon asked the Superior Court of Justice to determine "whether the municipal election held in North Bay October 22nd, 2018 was valid."

The documents were filed last Friday, January 18th.

Shannon told BayToday in January that a group of citizens were behind the action.

"We just want to make sure that every ballot was counted and what was the reason behind ballots not being scanned when the voter was present," stated Shannon. 

The application, which was filed in January by Shannon under the Municipal Elections Act, asked that the City Clerk be ordered to retain all ballots and other documents and materials related to the election beyond the statutory 120 days.

Due to the withdrawal, a hearing scheduled for April 10, 2019 in the Superior Court of Justice will not proceed.
