Health Unit withdraws charges against the City

The prosecutor on behalf of the North Bay Parry Sound District Health Unit today requested that the court withdraw charges against the City of North Bay, which were laid after the City refused to pay the full amount of the levy from the North Bay Parry Sound District Health Unit, for the 2006 Budget.

In withdrawing the charges, Greg Ellies, the prosecuting lawyer, advised the court that it was his opinion that it would 'be in the public interest' to withdraw the charges. Mr. Ellies advised the court that the City of North Bay has now paid an amount to the Board of Health, which is acceptable to both parties, together with interest.

Mr. Ellies subsequently indicated that the matter had been brought to a resolution based upon instructions obtained from the 2006 Board of Health, before it was dissolved, and provided further details concerning the amount that had been paid by the City.

The Board of Health had originally imposed a levy on the City in the amount of $2,011,428.00 for 2006. The City objected to the 2006 Cost-shared Budget upon which the levy was based. Instead, on March 13, 2006 City Council passed a Resolution authorizing payments in the annual amount of $1,661,427.00. The amount that has now been paid by the City of North Bay represents the City's apportionment of the 2006 Cost-shared Budget, in the total amount of $1,796,066.00.

In addition, the City has paid interest at the rate of 6% per annum on the amount of the original disputed levy, in the total amount of $5,533.85, in order that the other municipalities forming the Health Unit receive proper credit for the full amount of levies that they paid for 2006. As has been the practice of the Health Unit, all obligated municipalities will be reimbursed their proportionate share of any unexpended funds that they have paid to the Health Unit following the Unit’s year end financial audit.
