Stewart Township man charged with impaired driving

North Bay – On Saturday September 8, 2012 at 12:19 a.m., a southbound pick up truck was speeding on the by-pass in North Bay near Frost Street.

Members of the Ontario Provincial Police (OPP) were conducting speed enforcement patrol and conducted a traffic stop. The driver of the vehicle complied and was in possession of a Radar Detector Device affixed to his dashboard.

During the course of the traffic stop, the officer demanded a breath sample from the Roadside Screening Device to which the driver promptly failed. The driver was arrested for being in excess of 80mg of alcohol.

The driver consequently provided breath samples of 2 times the legal limit.

Russell KELLY age 22yrs of Stewart Township in Nipissing District was charged with;

Exceed 80 mgs blood alcohol content contrary to section 2531(b) of the Criminal Code of Canada

Drive motor vehicle with Speed Measuring Device contrary to section 79(2) of the Highway Traffic Act as well as Speeding.

KELLY was released on a Promise to Appear with a first appearance date in North Bay on September 18, 2012. He was also served a 90 day licence suspension, had his vehicle impounded for 7 days along with the seizure of his radar detector.
