OPP charge same driver three times within three days

Suspended driver faces more than 10 charges

This story is about a driver that did not seem to get the message.  

A 20-year-old St. Charles, Ontario resident is facing multiple charges after the individual was caught driving under suspension three times within a three day period from June 15 to June 17.   

In the first instance, Nipissing West OPP pulled over a motorist near King Street in St. Charles after observing a driver, known to police, as being suspended. 

The officer subsequently stopped the vehicle. Further investigation revealed the vehicle was not insured and the plates were not attached and were seized.

As a result, the 20-year-old driver, Kurtis Gervais from St. Charles, was charged with:

  • Drive While Under Suspension (Four Counts), contrary to section 53(1) of the Highway Traffic Act (HTA);
  • Use Plate not Authorized for Vehicle, contrary to section 12(1)(d) of the HTA;
  • Drive Motor Vehicle - No Permit, contrary to section 7(1)(a) of the HTA; and
  • Owner Operate Motor Vehicle on a Highway - No Insurance, contrary to section 2(1)(a) of the Compulsory Automobile Insurance Act (CAIA)

The second incident occurred less than 24 hours later. The OPP say around 11:15 a.m. on June 16, a Nipissing West OPP officer stopped a vehicle on Highway 17 near Kukagami Lake Road as a result of a suspicious vehicle complaint.  

That investigation revealed the driver was the same person as the one charged the previous day, driving a different vehicle. As a result of this stop, he was charged with:

  • Drive While Under Suspension (Four Counts), contrary to section 53(1) of the HTA; and
  • Drive Motor Vehicle - No Licence, contrary to section 32(1) of the HTA.

The accused is scheduled to appear at the Ontario Court of Justice on August 17, 2020, in Sudbury to face those charges.  

Then, on June 17, around 12:15 p.m., while on patrol, on Marsim Court, in Markstay-Warren, the Nipissing West OPP pulled over a vehicle that police say had no license plates attached.  

Again, the OPP say the driver was found to be Gervais behind the wheel once again.   

This time, as a result of the investigation Gervais was charged with:

  • Operation While Prohibited Under the Criminal Code, contrary to section 320.18(1)(a) of the Criminal Code (CC);
  • Driving While Under Suspension -While Suspended under HTA Section 41/42, contrary to section 53(1.1) of the HTA;
  • Drive While Under Suspension (Four Counts), contrary to section 53(1) of the HTA;
  • Use Plate not Authorized for Vehicle, contrary to section 12(1)(d) of the HTA; and
  • Operate a Motor Vehicle Without Insurance, contrary to section 2(1)(a) of the CAIA.

 In order to prevent the continuation of the offence, the vehicle was seized under the authority of section 217(4) of the HTA.  

The accused was released on an Appearance Notice and is scheduled to appear at the Ontario Court of Justice on August 19, 2020, in Sudbury.
