The man that was struck and badly injured in a traffic accident this morning had the right of way, is disabled and was crossing the street on his mobility scooter.

His son Shawn Foisy tells BayToday "This was my dad, He was hit crossing the road on his mobility scooter. Cops said my dad had the green light. Seeing his scooter under the front of an SUV is heart-wrenching. We are still unsure his condition."

He wrote on Facebook, "This ******* intersection at Champlain St and Mckeown are dangerous, Jim just got hit by a van going left while he was on his scooter. ☹️ Why do people think they can race and beat the pedestrian traffic to the crosswalk?? And Thank you to North Bay Police Service for offering to help and bring mom to the Hospital."

He says police told him that his Dad, Jim, had the walking man symbol at the crosswalk.

Foisy adds that both his parents are disabled. His Dad took care of his Mom and did all their errands.

Police have not released if any charges have been laid against the female driver.
