Ice huts owner accuses MNRF of entrapment

'This was all lies, no group of 6, just the mnr setting me up,' says Hyndman

Having pulled the ice hut off the lake, MNRF officers work to put the hut on a flatbed trailer.

The owner of the ice huts seized Monday off Lake Nipissing by the MNRF says the government used fake emails to deceive him into renting the huts to MNRF officers.

Ice Hut Rentals owner Marc Hyndman sent BayToday a series of emails, (included below) he says is proof he was set up.

"This is how our government is negligent and entraps it's own citizens. Read carefully each back and forth message. This was all lies, no group of 6, just the mnr setting me up," he wrote.

Hyndman also upped the ante by saying he will bill the MNRF for use of his ice huts.

"I am issuing the MNRF a bill for renting all 6 of my ice huts and a negligence fee of ten times the value of all my huts for stealing them and my means to provide for my family. Sleeper is worth $20,000 and 4 day huts are worth $2,500 and one is worth $500. So, $30,500 x 10= $305,000 for the penalty of theft plus my standard daily rates for renting them. Would you like to pay with Cash, E transfer or Check??? Depending on how quickly you work with me will determine how much you owe me for the theft of my business!

"It is all very disgusting! Settle or I will win everything I ask for and more in court. There is no precedent as I am the test case. I will win hands down."

MNRF spokesperson Jolanta Kowalski, said yesterday that "the matter is under investigation and it would not be appropriate to comment further."

BayToday has edited out addresses but not content, and has not corrected spelling in the emails provided by Hyndman.

Hi kevin, sorry for the late email. The sleeper hut is not 100% done yet. We still need mattresses and a few things to finish it off.  We have day huts that are available. If you still want the sleeper hut it will be finished in the next few weeks and i can book you if that works for you.

Thanks Marc, I spoke with the group and they are still game to come up for the fishing trip and stay in town.  There are 6 of us... do we need one or two huts and what are your prices?  Also, what kind of fish will we be catching and do we bring our own fishing rods and bait or can you supply us with the fishing gear and bait?
Thanks very much,

Hi kevin, we have charged $40 per person per day for the last 7 years, but really we are on a donation basis so its just a suggestion.  I have lots of rods and reels, i can bring bate or you guys can bring it, doesnt really matter. Bring lots of food and fun. You will be catching big jumbo perch, pike, walleye, ling. Bring a camping light if you want to camp at night.

If you really want the sleeper hut, all it needs is 6 mattresses and a couple bags of insulation. If you guys want to trade me that, you guys can come back afew times. Just a suggestion. If you have any questions please dont hesitate to ask.

Hey Marc, We decided to stay in town and make it day trips to your huts.  Some of the guys like heat and hot showers.  Can we rent 2 huts from you and it will be 6 guys.  It would be easier for us if you can supply the bait and well pay you when we get there.  We can bring $750 for the 4 days.  Are you good with that?  We will bring lots of food.  The fish sound good some guys want perch and some want walleye and one guy wants a big pike.  We can't bring up mattresses with our cars, might be one truck so we can sort out the money with you.  We should be there Monday afternoon to fish the evening, that ok?  Than back on Tuesdy and Wednesday and maybe back on Thursday.

Yeah Marc, we were planning on this monday, 1pm?  Does that still work for you?  Where are the huts, how do we get out to them by vehicle or snowmobile and think we will have to bring 2 cars and hoping one guy can bring his truck.  Is there room to park them there at the lake?

On Fri, Jan 13, 2017 at 10:16 PM, Marc wrote:

hey kevin, yes thats great with us, just wasnt sure the date lol. We are on Sunset point lake nipissing. We drive our truck out there, i wouldn't recommend driving a car out there. We are about a mile out, so 5 minutes truck ride. We can come pick you up at the boat launch or you can skidoo out there. Our skidoo is broken so we drive out.
At fhe boat launch there is a parking lot you can park your cars.

Sunset point is off of Lakeshore drive. There is a restaurant called Church hills, there also a hotel, and the road to sun set point is right beside it. If you need more directions let me know.

Those directions will work, we'll be at the launch at one.  Can you meet us there to take a couple guys out to the huts?  We will have one truck that can take 4 but no snowmobiles unfortunitlly.  I have been passing this info on to hte rest of the group.  I know they have some more questions and i'll send another e-mail this afternoon once i have heard back from the others.
Thanks Marc, should be a good time

Hi Marc, not sure why i volunteered to organize this fishing trip... its a lot of work!  Its all coming together but some of the guys have some questions as i mentioned earlier.  So if you can answer the questions here for me i will forward this e-mail to the entire group and they will all know what to bring and what the fish hut owner supplies... thanks for the help and patience.
Tom - wants to know if you drill holes for us, have tip ups and supply the bait and is this included in the price or extra?
Graydon - wants to know if the huts have heat, can we cook our meals out there on a stove and is there an outhouse...lol.
Pete and his 2 sons - will be paying by cheque or credit card for all three people for 4 days of fishing ... his wife wants to make out the cheque and wants to know who to make it out too and for how much ... or he can pay with a credit card.
Mike and I are just happy to be going fishing and have no questions ... except are the fish biting???  Do you have any pictures that you can pass along?
Except for Pete and his sons we will have cash and will give the money to you and you can do with it what you please ... unless we are supposed to make a donation then let us know what the deal is there.
Thanks Marc and Michelle,

Kevin

Hi kevin, the fish are bitting, we are in the sleeper hut going to have a fish fry for dinner. I drill holes for you, i have lots of tip ups you can use. Use of equipment is included in the donation.

The hut is heated, we use big buddy mr heaters, heated by propane. We have 2 huts with a woodstove and you can cook on both. (sleeper hut has a woodstove you can use and another hut has a woodstove you can cook on also.) We set up a bathroom in one of the huts.

We cant accept credit cards, for a cheque please make it out to my wife. Or you can send an e- transfer. let me know what they choose to do. We go by donations, whatever you want to donate to us is fine. If you have any other questions don't hesitate to ask.

Hi Marc, as i said earlier, not easy organzing a trip.

Pete's wife has made the cheque out for $300, for him and his two sons for the 4 days of fishing ... is that enough?  The rest of us will have cash.

Graydon wants to confirm that the huts we are renting have holes inside to fish from ... he likes to stay warm.  On that note to, do you supply the propane or wood?

And hopefully last question, only thing I didn't see answered was the bait, assuming minnows, are they included in the "donation" for the 4 days of fishing?

Thanks again, looking forward to Monday
