Baggie of smokes gets man charged

Here's an odd one.

On November 9th, a member of the West Parry Sound OPP stopped a speeding vehicle on Highway 124 in McDougall Township.

While he was talking with the driver, the officer noticed a clear zip lock bag with unmarked cigarettes in the front console of the car.

As a result of the investigation the passenger, Thomas Smith, 34 years of age from Seguin Township was charged with:

  • Possession of unmarked cigarettes contrary to the Tobacco Tax Act. 

Smith was issued a Provincial Offences Notice.

OPP say that under the Tobacco Tax Act, unless otherwise authorized, it is illegal to buy, possess or distribute any quantity of untaxed cigarettes or any untaxed tobacco product.

Persons may also face prosecution under the Federal Excise Act. http://www.fin.gov.on.ca/en/tax/tt/illegal.html
