A 17-year old Cobalt resident faces incest and sexual assault charges

The charge of sexual interference states that every person who, for a sexual purpose, touches, directly or indirectly, with a part of the body or with an object, any part of the body of a person under the age of sixteen years is guilty of an indictable offence.

OPP say that sexual incidents over the past two years involving a young person under the age of 18 has led to the arrest of two Cobalt teenagers.

On April 8 Temiskaming OPP started an investigation into a historical sexual assault in Temiskaming Shores.

A 19-year-old has been arrested and is charged with:

  • Invitation to sexual touching under 16 years of age,
  • Two counts 0f sexual assault on a person under 16 years of age
  • Two counts of sexual interference

The accused was held for a bail hearing and is scheduled to appear at the Ontario Court of Justice at a later date in Temiskaming Shores.

A 17-year old has been arrested is charged with:

  • Incest, contrary to section 155 of the CC,
  • Sexual Assault on a person under 16 years of age
  • Sexual interference
  • Invitation to sexual touching under 16 years of age, contrary to section 152 of the CC.

The accused was released on an undertaking and is scheduled to appear at the Ontario Youth Court of Justice at a later date in Temiskaming Shores.

The Criminal Code 155 (1) states that everyone commits incest who, knowing that another person is by blood relationship his or her parent, child, brother, sister, grandparent or grandchild, as the case may be, has sexual intercourse with that person.

The charge of sexual interference in Section 151 of the Criminal Code states that every person who, for a sexual purpose, touches, directly or indirectly, with a part of the body or with an object, any part of the body of a person under the age of sixteen years is guilty of an indictable offence.

This can include masturbation, oral sex, or intercourse. 

Invitation to sexual touching is "every person who, for a sexual purpose, invites, counsels or incites a person under the age of 16 years to touch, directly or indirectly, with a part of the body or with an object, the body of any person, including the body of the person who so invites, counsels or incites and the body of the person under the age of 16 years."

The OPP say they will not be releasing the names of the accused in order to protect the identity of the victim.
