Company fined for illegally building a dam

A company working on behalf of the Ministry of Transportation has been convicted for illegally building a dam in a river during construction of a highway project.



EXP Services Inc, was fined $3,000 for illegally constructing a dam in a river in contravention of the Lakes and Rivers Improvement Act.



Court heard that in October 2011, EXP Services Inc. provided direction to a local heavy equipment operator to construct an earthen dam in a water course without first acquiring the necessary written approvals from the Ministry of Natural Resources. The dam was utilized to temporarily impound water while contractors replaced a steel culvert across Monteith Road in Calvert Township.



Approval from the Ministry of Natural Resources under the Lakes and Rivers Improvement Act is required prior to altering, repairing or modifying any part of a dam.



Justice of the Peace Dolores Boyuk heard the case in the Ontario Court of Justice, Cochrane, on May 9, 2013.
